These Terms of Use (“Terms”) govern your access to and use of the website located at veloir.luxe and all related digital properties operated by VÉLOIR (“we,” “our,” or “us”), collectively referred to as the “Platform.” By accessing or using the Platform, you agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must discontinue use of the Platform immediately.
Description of Service
VÉLOIR is a luxury fashion editorial platform that publishes original editorial campaigns, photography, creative direction, and related content. The Platform serves as a curated digital publication presenting fashion editorials in a proprietary dossier format. Access to the Platform’s editorial content is provided for personal, non-commercial viewing unless otherwise expressly authorised under a separate licensing agreement.
Intellectual Property Rights
All content published on the Platform, including but not limited to editorial imagery, photographs, text, graphic design, typography, layout, visual compositions, creative direction, brand identity, and the VÉLOIR name and logo, is the exclusive intellectual property of VÉLOIR and its collaborators, protected by applicable copyright, trademark, and intellectual property laws.
No content from the Platform may be reproduced, distributed, modified, displayed publicly, performed, republished, downloaded, stored, transmitted, or otherwise exploited in any form or by any means without the prior written consent of VÉLOIR. This prohibition extends to the use of automated systems, scrapers, or any technology designed to extract content from the Platform.
The dossier format, editorial structure, and creative presentation of content on the Platform constitute proprietary trade dress and are protected accordingly. Unauthorised imitation of the Platform’s editorial format or visual identity is strictly prohibited.
Acceptable Use
You agree to use the Platform solely for lawful purposes and in a manner consistent with these Terms. The following activities are expressly prohibited:
Copying, downloading, or redistributing editorial content without authorisation. Using the Platform or its content for any commercial purpose without a valid licensing agreement. Attempting to gain unauthorised access to any portion of the Platform, its servers, or connected systems. Interfering with or disrupting the Platform’s infrastructure, performance, or availability. Using automated tools, bots, or scripts to access, scrape, or index Platform content. Misrepresenting your identity or affiliation when interacting with the Platform. Framing, mirroring, or embedding Platform content on external websites or applications without written permission.
We reserve the right to restrict or terminate access for any user who violates these provisions, without prior notice and at our sole discretion.
Editorial Content Disclaimer
Content published on the Platform is editorial in nature and is produced for creative and artistic purposes. Editorial campaigns, imagery, and accompanying text represent creative interpretations and artistic expression. They do not constitute factual reporting, product endorsements, or professional advice of any kind.
VÉLOIR makes no representations or warranties regarding the accuracy, completeness, or reliability of any editorial content. The creative direction, styling, and presentation of content reflect artistic choices made in the service of editorial vision and should be understood in that context.
Third-Party Links
The Platform may contain links to third-party websites, services, or resources that are not owned or controlled by VÉLOIR. We do not endorse, assume responsibility for, or guarantee the content, privacy policies, or practices of any third-party sites or services. You acknowledge and agree that VÉLOIR shall not be liable for any damage or loss caused by or in connection with your use of any third-party content, goods, or services.
Disclaimer of Warranties
The Platform and all content therein are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
VÉLOIR does not warrant that the Platform will be available uninterrupted, error-free, or free of harmful components. We do not guarantee that defects will be corrected or that the Platform or its servers are free of viruses or other harmful elements.
Limitation of Liability
To the maximum extent permitted by applicable law, VÉLOIR and its officers, directors, employees, agents, partners, and collaborators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Platform; any content obtained from the Platform; or unauthorised access to, use of, or alteration of your transmissions or content. This limitation applies regardless of the legal theory under which such liability is asserted.
Modifications to Terms
VÉLOIR reserves the right to modify or replace these Terms at any time at our sole discretion. Material changes will be reflected by updating the effective date at the top of this page. Your continued use of the Platform following the posting of revised Terms constitutes acceptance of those changes. It is your responsibility to review these Terms periodically.
Modifications to the Platform
VÉLOIR reserves the right to modify, suspend, or discontinue any aspect of the Platform at any time, with or without notice. This includes changes to content availability, features, functionality, and access conditions. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform or any part thereof.
Termination
We may terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Platform ceases immediately. All provisions of these Terms which by their nature should survive termination shall survive, including intellectual property provisions, warranty disclaimers, indemnity, and limitations of liability.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which VÉLOIR is established, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms shall remain in full force and effect.
